• In order to avail a Benefit, payments must be made using your Finance House Credit Card or your Islamic Finance House Covered Card only.

• Please identify yourself as a Finance House Credit Card holder or an Islamic Finance House Covered Card holder at the cashier or when asking for the bill.

• Benefit discounts may not be combined with any other promotions that the merchant may be offering at the given time.

• Some Benefits may have blackout dates, please check the Benefit’s specific Terms & Conditions or contact the merchant directly.

 

VALUE HOUSE TERMS & CONDITIONS

FOR USE OF E-APPLICATIONS

Value House FZC (“Value House”) is a free zone entity with limited liability incorporated under the regulations of Ras Al Khaimah Free Trade Zone and the laws of the UAE. We at Value House own all rights associated with “www.valuehouse.ae” (the “Website”) and Value House Application, to be accessed from electronic applications, and/or any other electronic means, (“Electronic Device(s)”) (hereinafter collectively referred to as “E-Application(s)”) and provide exceptional offers and further discounted rates for a variety of products and services (“Deals”) exclusively for clients of Finance House PJSC (“FH”) and Islamic Finance House Pvt. J.S.C (“IFH”) (the clients of FH and IFH shall each be referred to as “Customer” and collectively as “Customers”) who are credit card holders of FH and holders of covered cards of IFH (together the “Cards”).

• Within the conditions and limitations imposed by FH and IFH or such other third parties, throughout the validity of the Cards, Customers may avail the Deals by using the Cards to:

(i)  directly purchase products and services at discounted rates at a variety of outlets in the United Arab Emirates market (“Merchant Outlets”) selected by Value House from time to time as advertised on the E-Application;

(ii) purchase vouchers that are displayed on the E-Application representing a particular amount of value for products and services selected by Value House through certain arrangements with the Merchant Outlets from time to time as advertised on the E-Application (“Deal Vouchers”) to be redeemed by the Customers at the Merchant Outlets’ points of sale. The redemption and refund policy of any Deal Voucher relating to products and services shall be subject to the terms and conditions of the Merchant Outlet or as maybe displayed by Value House on the E-Application. The Deal Vouchers are generally subject to certain restrictions, including limitation on their volume and timeframe for sale, whereby Customers are advised to comply with such restrictions and limitations so as to meet their needs;

(iii) benefit from other exceptional Value House subsidized deals (such as “Killer Deals”) which will be commonly announced on the E-Application from time to time;

(iv)  benefit from value vouchers, will be issued in electronic form only, which may be either won by playing the available game(s) on the Electronic Device or which may be received as a gift from Value House (“Value Vouchers”). The Customers will be able to store and redeem the Value Vouchers electronically;

(v) avail from periodic promotions based on accumulating a certain volume of spending from using their Cards in a given period of time, as may be advised by Value House from time to time, whereby they would be entitled to enter promotion draws.

• Within the conditions and limitations imposed by FH and IFH or such other third parties, throughout the validity of the Cards, the E-Application users including Customers (“User(s)”) may access and benefit from the following features:

(i) a ‘Geo – Locator’ feature available on the Electronic Devices’ only. Value House shall not be held responsible or liable in any manner whatsoever for any inaccuracy or inconvenience caused to the Users from the use of this feature;

(ii) a ‘Live Chat’ feature available on the E-Application to avail the assistance of IFH’s or FH’s customer care representatives. The Users shall use this feature to seek guidance in case of any queries or questions they may have in relation to the features available on the E-Applications; and/or

(iii) an ‘Easy Payment Plan’ (EPP) Calculator feature available on the E-Application to  calculate the monthly installment amount for purchases to be made at Merchant Outlets.  The Users shall understand that such calculations are indicative in nature and Value House shall not be held responsible in any manner whatsoever for any inaccurate calculations made or shown by this feature. The User(s) shall contact or refer to IFH or FH for any further assistance required herein, if the User(s) decide(s) to opt for such EPP plan or scheme.

Herein are the terms and conditions (the “Terms & Conditions”) that govern the use of the E-Application and the Deals via the E-Application.

By accessing and using the E-Application, Customers hereby agree to the Terms & Conditions.  The Terms & Conditions are effective and binding upon their acceptance at the time of registration by the Customers on the E-Application.  Value House may amend any terms of these Terms & Conditions at any time by posting the amended terms and conditions on the E-Application (“Amended Terms & Conditions”).  The Amended Terms & Conditions shall become effective upon publication on the E-Application and any subsequent use of the E-Application shall be governed by the Amended Terms & Conditions. The Terms & Conditions shall be binding along with the Cards terms and conditions, which will govern the payment and use of the Cards and determine the Customers’ rights and liabilities as cardholders. Customers are advised to regularly check for any amendments or updates to the Terms & Conditions. If any provision of these Terms & Conditions shall be deemed invalid, void or for any reason, unenforceable, such provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions of these Terms & Conditions. In order to access, use and make purchases from any of the E-Applications, the Customer must first subscribe to that E-Application by establishing a customer account (“Membership Account”). Customer must therefore read, agree and accept the Terms & Conditions, the respective E-Application’s Privacy Policy, methods of payment and refund policy before he/she may subscribe to the E-Application.  BY CLICKING “I Agree to the Terms and Conditions and the E-Application’s Privacy Policy, methods of payment and refund policy” YOU AGREE TO THESE TERMS AND CONDITIONS AND THE E-APPLICATION’S PRIVACY POLICY AND THE METHODS OF PAYMENT AND REFUND POLICY INCORPORATED HEREIN.  IF YOU DO NOT AGREE, DO NOT CLICK ON THE BUTTON AND DO NOT USE THE E-APPLICATION.

Links

The links referred to in these Terms & Conditions are related to pages and websites of our subsidiary or affiliate entities. By agreeing to subscribe to the E-Application, the Customer also agrees that his/her use of websites of our subsidiary or affiliate entities will be governed by the agreements and policies posted on their respective websites. In the event of the E-Application’s Terms & Conditions, Privacy Policy, methods of payment and refund policy incorporated herein, being inconsistent with the agreements and policies of such other websites, the latter will prevail.

The E-Application may also contain links to pages and websites of the Merchant Outlets or other third parties (“Third Party Websites”). These links are provided solely as a convenience to the Customers and not as an endorsement by Value House of the content on such Third Party Websites.  Value House is not responsible for the content of linked Third Party Websites and does not make any representations regarding the content or accuracy of materials on Third Party Websites. If the Customer decides to access linked Third Party Websites, he/she may do so at its own risk, and we encourage the Customers to review the terms and conditions of the Third Party Websites as they will apply to their use of such Third Party Websites.

Membership Account

If the Customer uses the E-Application he/she shall be responsible for maintaining the confidentiality of his/her Membership Account and access password. The Customer agrees to assume responsibility for all activities that occur in relation to his/her Membership Account its access password. The Customer should inform us immediately if he/she has any reason to believe that his/her password has become known to anyone else, or if the password is being, or is likely to be used in an unauthorized manner. If the Customer is under 18 years of age, he/she may use the E-Application only with the consent of a parent or guardian. Value House reserves the right to terminate the Customer’s Membership Account, remove or edit the contents on the E-Application or cancel purchase transactions in his/her sole and absolute discretion. If any of the Customer’s details change, such as the Cards’ billing address, the Customer must inform FH or IFH (as the case may be) immediately. The Customer may update his/her details by signing into his/her Membership Account and updating the relevant section.

License to use the E-Application

We hereby grant the Customer a limited, non-exclusive, revocable license to access and make personal use of the E-Application. The Customer shall not download (other than page caching) or modify the E-Application, or any portion thereof, except with our express written consent. The Customer agrees that he/she shall not use the E-Application for any of the following: in violation of any applicable law or regulation; to access data not intended for the Customer or logging into a server or account which he/she is not authorized to access; to transmit, distribute, store or destroy material that is obscene, defamatory, threatening, harassing, abusive, hateful or embarrassing to another use or any other person or entity, or contains sexually explicit images or statements; to copy or adapt the HTML code created to generate any content of the pages making up the  E-Application; to impersonate or otherwise misrepresent his/her identity or affiliation with any other person or entity; or to send unsolicited mail or email, making unsolicited phone calls or sending unsolicited faxes regarding promotions and/or advertising of products or services to a user of the  E-Application.

The license granted under these Terms & Conditions does not include any permission for resale, modification, reproduction, distribution, or for any public or commercial use of the  E-Application or its contents; any collection and use of any product and service listings, descriptions, or prices; any derivative use of the E-Application or its contents; any downloading or copying of account information for the benefit of another merchant or user; or any use of data mining, robots, or similar data gathering and extraction tools. The E-Application or any portion of it may not be copied, reproduced, duplicated, sold, resold, visited, or otherwise exploited for any commercial purpose without our express written consent. The Customer may not frame or use framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) on the E-Application and/or on the websites of its subsidiaries and affiliates for any purpose without our express written consent. The Customer may not use any meta tags or any other “hidden text” utilizing Value House or its subsidiaries’ and affiliates’ names and/or trademarks without our express written consent. The Customer may not use the E-Application to transmit, distribute, store or destroy material, including without limitation any content on the E-Application, in a manner that will infringe the copyright, trade mark, trade secret or other intellectual property rights of Value House or others or violate the privacy, publicity or other personal rights of others. Any unauthorized use forthwith terminates the permission or license granted by us hereunder. We also grant the Customer a limited, revocable, and non-exclusive right to create a hyperlink to the Welcome/Home page only of the Website for personal use as long as the hyperlink does not portray the Website, Value House and/or its subsidiaries and affiliates, or any of Value House and/or its subsidiaries’ and affiliates’ products and/or services in a false, misleading, derogatory, or otherwise offensive matter. The Customer may not use any Value House or any of its subsidiaries’ and affiliates’ logos or other proprietary graphic or trademark as part of the hyperlink for any purpose without our express written consent.  The Customer may not use any automatic or electronic device, program, algorithm or methodology, or any similar or equivalent manual process, to access, acquire, copy, probe, test or monitor any portion of the E-Application or any of its contents, or in any way reproduce or circumvent the navigational structure or presentation of the E-Application or any of its contents, to obtain or attempt to obtain any materials, documents or information through any means not normally made available through the E-Application. The Customer agrees that he/she will not take any action that imposes an unreasonable or disproportionately large load on the infrastructure of the E-Application or any of the systems or networks comprising or connected to the E-Application, to attempt to decipher, decompile, disassemble or reverse engineer any of the software comprising or in any way making up a part of the E-Application. The Customer also agrees that Value House may, in its sole discretion and without prior notice to the Customer, terminate or suspend the Customer’s access to the E-Application and/or the Customer’s Membership Account for any reason, including without limitation: (i) any attempt by the Customer to gain unauthorized access to the E-Application or the Customer assisting any unauthorized third party in attempting to do so, (ii) overcoming software security features limiting use of or protecting any content of the E-Application, (iii) discontinuance or material modification of the E-Application or any service offered on or through the E-Application, (iv) any violation by the Customer of these Terms & Conditions, (v) the Customer’s failure to pay for any Deal Voucher or other purchases on the E-Application, (vi) any suspected or actual copyright infringement by the Customer, (vii) unexpected operational difficulties, or (viii) requests by a court of law, competent authorities or other governmental agencies. The Customer agrees that Value House will not be liable to the Customer or to any third party for termination or disruption or suspension of the Customer’s access to the E-Application and/or his/her Membership Account.

Electronic Communication

When the Customer visits the E-Application or sends e-mails to Value House, he/she is communicating with us electronically and he/she consents to receive communications from us electronically. We will communicate with the Customer by e-mail or by posting notices on the E-Application. The Customer agrees that all agreements, notices, disclosures and other communications that we provide to the Customer electronically satisfy any legal requirement that such communications be in writing. The E-Application requires the Customer’s consent during the registration process of his/her Membership Account to occasionally send the Customer promotional e-mails from the E-Application. These emails announce new Deal Vouchers (applicable only in case of Website), changes and features added to the E-Application to enhance the Customer’s E-Application experience as well as all special promotions that may be hosted by the E-Application. Customers are expected to refer to our Privacy Policy for more details on the use of the Customer’s personal information. To stop receiving our marketing emails, Customers are requested to send an e-mail to us at  help4u@valuehouse.ae with “Opt-Out” in the subject or follow the opt-out procedures set forth in such marketing emails.

Equipment

It is the Customer’s responsibility to obtain and maintain all electronic devices and other equipment which may be required to access the E-Application and settle all costs, expenses and charges related thereto. Value House shall not at any time be liable for any damages to such electronic devices and other equipment resulting from the use of the E-Application.

Deal Voucher Redemption

The Merchant Outlet promotes its products and services by displaying the same on the E-Application through us. This means we collect money from the Customer on the Merchant Outlet’s behalf and issue Deal Vouchers for the Customer to be redeemed for products and services at these Merchant Outlets. The respective Merchant Outlet, not the E-Application, is the actual seller of products and provider of services that the Customer acquires by purchasing the Deal Coupon, and is solely responsible for the fulfillment of such products and services in exchange of the Customer presenting his/her Deal Voucher  to the Merchant Outlet as required. The offers made through the E-Application by the Merchant Outlets cannot be availed in conjunction with any other offers made by the Merchant Outlets. Such offers will not necessarily be valid during the sale periods of any of the Merchant Outlets. Value House takes no responsibility for the products and services for which Deal Vouchers may be redeemed, and does not warrant the standard, usability quality, or other aspect of any product or service for which a Deal Voucher is redeemed. The display of products and services are subject to the separate contractual terms and conditions on which they are offered and may be withdrawn or amended at any time without notice. Value House bases its promotional material on information provided by the Merchant Outlet or its affiliates and makes no warranty about the standard, quality, merchantability or fitness for purpose of any product or service offered by any Merchant Outlet. Customers are requested to be careful with their Deal Voucher and the codes displayed on it. These codes can be redeemed by anyone and once used cannot be redeemed again. Subject to each Deal Voucher terms and conditions, Value House will not be responsible for any refunds in any situations. If these codes are given to the Merchant Outlet at the time of reservation (as reservation may be required by the Merchant Outlet) and if not utilized for the reservation, the Merchant Outlet may, at its discretion, consider the Deal Voucher redeemed and the E-Application and Value House will not be responsible for any refunds in any situations, and the Customer will have to settle any discrepancy directly with the Merchant Outlet.

Intellectual Property

All contents included on the E-Application, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software, is owned by Value House, its subsidiaries and affiliates or its content suppliers and are variously protected by the prevailing laws of the United Arab Emirates (“UAE”) and other countries. All product names, trade names, service names, tag lines, or logotype distinguished in form, text, or otherwise from surrounding text (e.g. all capital letters), (collectively, “Marks”) are trademarks owned by or licensed to Value House unless otherwise noted. The Marks on the E-Application are variously protected by the prevailing laws of the UAE and other countries. Except as otherwise stated in these Terms & Conditions, the Customer may not use, modify, publish, transmit, participate in the transfer or sale, create derivative works, or in any way exploit, any of the content on the E-Application, in whole or in part without the express permission of Value House or the respective copyright Mark owner. All contents as compiled on the E-Application are the exclusive property (including copyright) of Value House, with Value House as author for this compilation, and is protected by UAE and international copyright laws. Photographs of all products and services displayed on the E-Application are for illustrative purposes only and all the Customers are requested to read and confirm the details and description of the Deal Voucher before purchasing it from the E-Application.

Defamatory Material

Descriptions and images are provided by each Merchant Outlet and displayed on the E-Application. Such descriptions and images are neither endorsed by Value House nor is Value House responsible for such descriptions and images. We therefore rely on the Customer’s input for us to either make changes to or remove from the E-Application any descriptions and/or images that he/she may consider to be defamatory, damaging or insulting material. If the Customer believes that any content on or advertised on the E-Application contains descriptions or images that are defamatory, damaging or insulting, please notify us immediately via email at help4u@valuehouse.ae. Once the Customer has provided us such notification, we will undertake all reasonable endeavors to investigate the claim, and if necessary, remove the defamatory, damaging or insulting content from the E-Application within a reasonable timeframe.

Payment Terms and Conditions of Sale

To purchase any Deal Voucher on the E-Application, through the Membership Account the Customer must be (a) at least eighteen (18) years of age (b) a natural person (therefore not a corporation, partnership or other legal entity). Prior to the purchase of any Deal Voucher on the E-Application, the Customer must provide us with a valid Card number and associated payment information including all of the following: (i) the Customer name as it appears on the relevant Card, (ii) the Customer Card number, (iii) the Card type, (iv) the date of expiration on the Card and (v) any activation numbers or codes needed to charge the Customer Card. By submitting that information to us, the Customer hereby agrees that he/she authorizes us to charge its Card at our convenience but in any case within thirty (30) days of Card authorization. All sales of Deal Vouchers are final and all charges from those sales are NONREFUNDABLE, except if otherwise provided on each Deal Voucher terms and conditions. Except for FH and IFH (as the case may be), the E-Application will not pass on the Customer personal or Card details to any third party except where an additional security check may be deemed necessary.

Methods of Payment and Card Terms

All payments on the E-Application must be made by the Cards. Value House may, in its sole and absolute discretion, limit or prevent the use of the Cards on the E-Application.  If any card other than the Cards is used for any transaction on the E-Application, the transaction will automatically be rejected.. The Terms and Conditions of the Cards govern the payment and use of the Cards by the Customer whereby the Customer must refer to such Terms and Conditions and not the E-Application Terms & Conditions to determine his/her rights and liabilities as a cardholder. The Customer, and not the E-Application, is responsible for paying any unauthorized amounts billed to his/her Card by a third party. The Customer agrees to pay all taxes, fees and charges incurred or charged in connection with his/her purchases on the E-Application at the rates in effect when the charges were incurred. Unless he/she notifies the E-Application/Value House of any discrepancies within sixty (60) days after they first appear on his/her Card statement, the Customer agrees that such discrepancies will be deemed accepted by the Customer for all purposes. If the E-Application does not receive any payment made through the same E-Application from the Card issuer, the Customer agrees to immediately pay all amounts due upon demand by Value House E-Application.

Indemnity

The Customer agrees to indemnify and hold Value House and (as applicable) its parents, subsidiaries, affiliates, officers, directors, agents, and employees harmless from and against any claim or demand (including all costs or expenses incurred by the E-Application, including, without limitation, Value House attorneys’ fees and legal expenses) made by any third party due to or arising out of the Customer’s breach of these Terms & Conditions, or the Customer violation of any law or the rights of a third party. The E-Application is not responsible for the quality of products, services or the experience provided by the Merchant Outlet. However, if the Customer is dissatisfied with the products, services or the experience offered by Merchant Outlet, they can always write to us at help4u@valuehouse.ae and Value House will look into the matter immediately. Value House may carry out transactions or refunds in its sole and absolute discretion depending on the terms and conditions of each Deal Voucherand the existing terms and conditions for refunds available at the Merchant Outlet.

DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY

THE E-APPLICATION IS PROVIDED BY US ON AN:  “AS IS” AND “AS AVAILABLE” BASIS. WE MAKE NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE ACCURACY, RELIABILITY, COMPLETENESS, CURRENTNESS AND/OR TIMELINESS OF ANY CONTENT, INFORMATION, SOFTWARE, TEXT, GRAPHICS, LINKS OR COMMUNICATIONS PROVIDED ON OR THROUGH THE USE OF [www.valuehouse.ae] (INCLUDING THOSE PROVIDED ON THIRD PARTY WEBSITES) OR THAT THE OPERATION OF THE E-APPLICATION OR THIRD PARTY WEBSITES WILL BE ERROR FREE AND/OR UNINTERRUPTED. THE CUSTOMER EXPRESSLY AGREES THAT HIS/HER USE OF THE E-APPLICATION IS AT THE CUSTOMER SOLE RISK. TO THE FULL EXTENT PERMISSIBLE BY APPLICABLE LAW, THE E-APPLICATION DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. WE WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF [www.valuehouse.ae], INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES ON ANY ACCOUNT WHATOSOEVER. VALUE HOUSE’S LIAIBLITY IN ANY CIRCUMSTANCE IS LIMITED TO THE PRICE, IF ANY, PAID BY THE CUSTOMER FOR THE DEAL VOUCHER THROUGH THE USE OF THE E-APPLICATION. VALUE HOUSE is not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers or providers, delays, failures, computer equipment, software, failure of any email due to technical problems or traffic congestion on the Internet or on the  E-Application or combination thereof, including any injury or damage to any users or to any person’s computer/device related to or resulting from participation or downloading materials in connection with the E-Application. VALUE HOUSE is neither responsible nor guarantees the quality of the products/services at the participating Merchant Outlets nor it is liable for any defects or shortcomings or for facilitating the process of the products/services so obtained/availed by FH or, where permissible, IFH Cards at the participating Merchant Outlet.

MISCELLANEOUS

The Customers are required to review the Privacy Policy posted on this E-Application and methods of payment and refunds policy incorporated herein. These policies are binding and govern the Customer use of the E-Application. Failure of Value House to exercise or enforce any right or provision of these Terms & Conditions shall not constitute a waiver of such right or provision.  If any provision of these Terms & Conditions is found by a court of competent jurisdiction to be invalid, the court should nevertheless endeavour to give effect to the parties’ intentions as reflected in the provision, and the other provisions of these Terms & Conditions remain in full force and effect. These Terms & Conditions shall be binding upon and inure to the benefit of Value House’s successors and assigns. By accessing and using the E-Application, the Customer agrees that the laws of the UAE, without regard to principles of conflict of laws, will govern these Terms & Conditions and any dispute of any sort that might arise between the Customer and Value House or its subsidiaries and affiliates. The courts of the Emirate of Abu Dhabi shall have jurisdiction over any dispute arising out of or connected to these Terms & Conditions.  The application of the United Nations Convention on Contracts for the International Sale of Goods is hereby expressly excluded.
